1Nature of Aashray's Services

Aashray operates primarily as a property search and discovery platform.

Aashray may:

• Display property listings submitted by landlords, property owners or other users.
• Allow tenants/users to search and filter properties based on location, rent, property type and other available information.
• Provide contact information or communication options to facilitate direct contact between users and property owners/landlords.
• Provide tools that help users discover and compare available properties.

Aashray does NOT:

• Own, rent, lease, manage or control the properties listed on the platform.
• Act as a landlord, tenant, broker, real-estate agent, property manager or legal representative.
• Guarantee that a property exists, is available, is accurately described or remains available.
• Guarantee the identity, background, financial position or conduct of any landlord, tenant or other user.
• Negotiate rental agreements on behalf of users.
• Guarantee the quality, safety, legality, condition or suitability of any property.
• Collect rent, security deposits or other payments unless expressly stated for a specific service.
• Guarantee that a landlord or tenant will respond to a contact request.
• Guarantee that a rental transaction will take place.

2For Tenants / Property Seekers

As a tenant or property seeker, you understand and agree that:

2.1 Independent Verification

You are solely responsible for verifying the property and the information provided by the landlord/property owner. Before making any payment or entering into an agreement, you should independently verify:

• Property address and existence.
• Ownership or authority of the person offering the property.
• Rent and security deposit.
• Availability and property condition.
• Amenities, facilities, utility and maintenance charges.
• Rules, restrictions and other relevant information.
• Identity and contact details of the landlord/property owner.

2.2 Payments

Do not make any payment solely because a property appears on Aashray. Aashray is not responsible for any loss resulting from:

• Advance payments, security deposits, booking or token amounts.
• Rent or brokerage payments.
• Fraudulent payment requests.
• Payments made to another user.

Independently verify the recipient and transaction before making any payment.

2.3 Direct Dealings

Any communication, negotiation, visit, agreement, payment or transaction between a tenant and landlord is conducted directly between those parties. Aashray is not a party to the rental agreement unless expressly stated otherwise.

3For Landlords / Property Owners

If you list a property on Aashray, you agree that:

3.1 Accurate Information

You will provide accurate and up-to-date information regarding your property — including address, rent, security deposit, property type, availability, amenities, photographs, rules and contact details. You must not knowingly provide false, misleading, fraudulent or deceptive information.

3.2 Right to List Property

You represent that you own the property or have appropriate authority from the owner to advertise it. You are responsible for obtaining any permissions necessary to list.

3.3 Tenant Dealings

You are solely responsible for:

• Verifying prospective tenants and conducting background checks where appropriate.
• Negotiating rent, collecting deposits and rent.
• Executing rental/lease agreements.
• Complying with applicable rental laws.
• Maintaining the property and returning deposits where applicable.
• Resolving disputes with tenants.

4Contact Information

Aashray may provide or facilitate access to contact information (phone numbers, email addresses, contact forms, etc.) solely to facilitate communication regarding properties.

Users must not use contact information obtained through Aashray for:

• Spam, harassment or threats.
• Fraud or unsolicited marketing.
• Unlawful activities.
• Any purpose unrelated to legitimate property enquiries.

Aashray may restrict or terminate access to users who misuse contact information.

5No Guarantee of Listings

Property listings may be submitted by users or third parties. Aashray does not guarantee the accuracy, completeness, authenticity or availability of any listing. A listing may:

• Become unavailable or contain outdated information.
• Have incorrect pricing, inaccurate photographs or descriptions.
• Be removed by the owner.
• Be listed by someone who is not authorised to represent the property.

Independently verify all information before relying upon it.

6No Guarantee of User Identity

Aashray may provide contact information or user profiles, but this does not constitute a guarantee that the person is the actual property owner, is authorised to rent the property, is the actual tenant, is financially capable of fulfilling their obligations, or is safe or trustworthy. Users are responsible for conducting their own verification and due diligence.

7Rental Agreements

Any rental, lease, licence, PG arrangement or other agreement entered into through contacts obtained from Aashray is solely between the relevant parties. Aashray is not responsible for:

• The terms or performance of the agreement.
• Breach of agreement, non-payment of rent.
• Security deposit, eviction, property damage or personal disputes.
• Utility, maintenance or possession disputes.

Obtain appropriate legal advice and execute appropriate documentation where necessary.

8User Conduct

Users must not use Aashray to:

• Publish fraudulent listings or misrepresent property ownership.
• Impersonate another person or collect money fraudulently.
• Upload misleading property information.
• Harass another user.
• Scrape or misuse contact information, or send spam.
• Conduct illegal activities.
• Upload unlawful, offensive or infringing content.
• Circumvent platform security or attempt unauthorised access.

Aashray may remove listings, restrict accounts or suspend/terminate access where misuse is suspected or identified.

9User-Generated Content

Landlords and users may provide property photographs, descriptions, pricing information and other content. By submitting such content, you represent that you have the necessary rights and permissions. You grant Aashray a non-exclusive right to use, reproduce, display and distribute such content for operating, promoting and improving the platform, subject to applicable law and our Privacy Policy.

10Third-Party Information

Aashray may display information provided by users or obtained from third-party sources. Aashray does not guarantee the accuracy or reliability of such information. Any reliance on information displayed on Aashray is at the user's own discretion and risk.

11Limitation of Liability

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

12Indemnification

To the extent permitted by applicable law, users agree to indemnify and hold harmless Aashray and its owners, employees, affiliates and representatives from claims, losses, liabilities, damages, costs and expenses arising from:

• Their use of the platform.
• Their violation of these Terms.
• Information or content submitted by them.
• Their dealings with another user.
• Their rental or property transaction.
• Their violation of applicable law or third-party rights.

13Property Disputes

Any dispute concerning a property, landlord, tenant, rent, deposit, agreement, possession, property damage or other transaction shall primarily be resolved between the relevant parties. Users may report fraudulent, abusive or inappropriate activity to Aashray, and Aashray may take reasonable platform-level action where appropriate.

14Platform Availability

Aashray does not guarantee that the platform will always be available, error-free, secure, uninterrupted or free from technical issues. Aashray may modify, suspend or discontinue portions of the platform at any time.

15Account Suspension

Aashray reserves the right to suspend, restrict or terminate an account or remove a listing where we reasonably believe that a user has violated these Terms, provided fraudulent information, engaged in abusive behaviour, misused contact information, attempted to defraud another user, violated applicable law, or created a security or safety risk.

16Privacy

Use of Aashray is also subject to our Privacy Policy, which explains how personal information and contact information are collected, used and handled. Users should not share sensitive personal or financial information unnecessarily with other users.

17Changes to These Terms

Aashray may update these Terms from time to time. Updated Terms will be published on the platform with a revised "Last Updated" date. Continued use of Aashray after changes are published constitutes acceptance of the updated Terms, subject to applicable law.

18Governing Law

These Terms shall be governed by the laws applicable in India. Subject to applicable law, disputes relating to these Terms or the use of Aashray shall be subject to the jurisdiction of the appropriate courts having jurisdiction over the relevant matter.
